1) Ministerstvo spravedlnosti však oproti tomu nemá zákonné kompetence k tomu, aby
jakkoli zasahovalo do samotného postupu exekučního soudu či soudního exekutora, tudíž
není ani oprávněno rušit exekuční příkazy, či zastavovat exekuční řízení. V konkrétním
řízení proto musí účastník sám podávat příslušné procesní návrhy a opravné prostředky
soudnímu exekutorovi či exekučnímu soudu. 2) Přijměte tedy informaci, že Ministerstvo spravedlnosti, nevykonává státní dohled nad
činností soudů při rozhodování v občanskoprávním, exekučním, insolvenčním či jiném
řízení a nemá tudíž pravomoc přezkoumávat postup soudu, který jejich vydání předcházel.
Jakýkoli zásah by byl v rozporu s principem dělby moci, který je základním pilířem
demokratického právního státu. Správnost postupu soudu může přezkoumat pouze soud
vyššího stupně na základě opravných prostředků podaných účastníky řízení.
3) Jelikož jste mj. namítala, že exekuční příkaz byl nečitelně podepsán přes razítko,
přičemž se zřejmě jednalo o podpis exekutorského kandidáta Mgr. Karla Páska, který však
nemá mít dle Vašeho názoru oprávnění vydávat exekuční příkazy, přijměte prosím informaci,
že podle § 25 exekučního řádu platí, že soudní exekutor může kandidáta písemně pověřit
prováděním úkonů v exekuční nebo další činnosti. Exekutorský kandidát je tak v mezích
tohoto pověření oprávněn listinu vydávanou z pověření exekutora podepsat vlastním
podpisem. Samotná skutečnost, že listinu nepodepsal osobně soudní exekutor, nezpůsobuje
bez dalšího její vadnost.
4) Dále přijměte informaci, že k doručování listinných dokumentů využívá soudní
exekutor službu České pošty, s.p., tzv. hybridní poštu. Tato služba zahrnuje zejména
převedení obsahu zásilky z elektronické podoby do podoby listinné, tedy vytištění
jednotlivých dokumentů vydaných soudním exekutorem nebo jím pověřeným zaměstnancem
v exekuční věci, jejich vložení do obálky včetně příloh a přepravu zásilky k adresátovi. Tento
postup je v souladu s ustanovením § 17b stavovského předpisu Exekutorské komory České
republiky ze dne 23. 5. 2002 (Kancelářský řád). Dle tohoto ustanovení listinné stejnopisy,
které se vyhotovují za součinnosti provozovatele poštovních služeb, mohou být opatřeny
vizualizovanou podobou uznávaného elektronického podpisu toho, kdo písemnost podepsal.
Provozovatel poštovních služeb může opatřit takový stejnopis řídícími znaky
pro vyhotovování. K písemné žádosti účastníka, kterému byl listinný stejnopis doručen,
se zašle elektronickou poštou na elektronickou adresu uvedenou v žádosti písemnost
vyhotovená v elektronické podobě a podepsaná podle § 16a Kancelářského řádu
nebo se předá účastníkovi v sídle úřadu na technickém nosiči dat; o tom musí být účastník
poučen.
5) S ohledem na výše uvedené přijměte, prosím, závěrem informaci, že Ministerstvo
spravedlnosti na základě Vašeho podání neshledalo důvody pro zahájení výkonu
státního dohledu nad postupem jmenovaného soudního exekutora podle § 7 exekučního
řádu.
